On August 1st, Senator Rob Portman (R-OH) introduced S.1693 – the Stop Enabling Sex Traffickers Act of 2017 which would amend the Communications Decency Act (SESTA).  SESTA redefines child sex trafficking under 18 USC §1591 to include “knowing conduct by an individual or entity, by any means, that assists, supports, or facilitates a violation of subsection,” while amending Section 230 of the Communications Decency Act (CDA230) to make clear that it does not (i) impair State criminal or civil enforcement actions targeting sex trafficking or (ii) private actions for damages.

The Senate Commerce Committee unanimously passed SESTA on November 8th.

On August 9th (CLBR #268), we had Taina Bien-Aimé, the Executive Director of the Coalition Against Trafficking in Women who spoke in favor of the bill.

Santa Clara University School of Law Professor Eric Goldman, a staunch defender of CDA230, has been one of the leading opponents of the bill and even testified against it.

GOLDMAN2Eric Goldman is a Professor of Law at Santa Clara University School of Law (SCU Law), where he is also Director of the school’s High Tech Law Institute.  His research and teaching focuses on Internet law, intellectual property and marketing law.

Before becoming a full-time law professor, Eric practiced law in the Silicon Valley for 8 years, first as a technology transactions attorney at Cooley Godward LLP and then as General Counsel of Epinions.com, an Internet start-up company. Prior to Santa Clara, he was an Assistant Professor at Marquette University Law School in Milwaukee, Wisconsin. He has also taught as an adjunct professor at UC Berkeley Law School and the University of San Francisco Law School.

He blogs on Internet law matters at the Technology & Marketing Law Blog, which is one of the most influential internet law blawgs in the U.S.

Eric recently curated a series of essays on Zeran v. AOL for Law.com (Commemorating the 20th Anniversary of Internet Law’s Most Important Judicial Decision) and on February 2, 2017, SCU Law is hosting a conference on Content Moderation & Removal at Scale.

Eric is also an advocate in the fight against lung cancer.
